Terms and Conditions

Preamble

The online sales website germie-en.mywizi.com is operated by Germie SAS, a simplified joint-stock company registered with the Trade and Companies Register of Saint-Brieuc under number 908 318 876, whose registered office is located at 10 Chemin de Prat Meur, 22970 Coadout, France.

These terms govern the sale of its products by Germie SAS to any natural or legal person making a purchase via the germie-en.mywizi.com website, hereinafter referred to as "the CUSTOMER".

These Terms and Conditions of Sale, the order form and the order confirmation constitute the sales contract between Germie SAS and the CUSTOMER for the products ordered.

Any order placed on the germie-en.mywizi.com website implies the CUSTOMER prior and unreserved acceptance of these Terms and Conditions of Sale. If the CUSTOMER does not accept these terms, they must not use the Site.

Germie SAS reserves the right to adapt or amend its Terms and Conditions of Sale at any time and without notice, the amendments then applying to subsequent orders. In the event of an amendment, the terms applicable to the CUSTOMER order are those online and accepted on the day of the order.

Article 1 - Definitions

Terms and expressions identified by a capital letter have the following meaning, in both the singular and the plural.

Terms and Conditions of Sale: this document, which applies to the relationship between Germie SAS and the CUSTOMER.
Order: the CUSTOMER order form for one or more Products, placed via the Site or Customer Service.
Site: the website accessible at germie-en.mywizi.com.
Product: a product or service offered for sale on the Site (germination kits, seed sprouters, soil analyzers, gardening accessories, etc.).
CUSTOMER: a natural or legal person, a consumer, who uses the Site and acquires one or more Products for personal needs, after accepting these Terms and Conditions of Sale.

Article 2 - Purpose

The purpose of these Terms and Conditions of Sale is to define the contractual relationship between Germie SAS and the CUSTOMER, as well as the conditions applicable to any purchase made on the Site.

By accepting these Terms and Conditions of Sale, the CUSTOMER declares that they are of legal age in their country of residence. Use of the products for illegal or unauthorised purposes is prohibited.

Germie SAS reserves the right to amend these terms at any time, in order to comply with any new regulation or to improve use of the Site. The applicable terms are those in force on the date of the CUSTOMER order.

Article 3 - Price

The prices shown on the product pages of the catalogue are expressed in euros (€), inclusive of all taxes (TTC), reflecting the French VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products.

Germie SAS reserves the right to modify its prices at any time, it being understood that the price shown in the catalogue on the day of the order is the only one applicable to the CUSTOMER.

The products remain the property of Germie SAS until full payment of the price.

Products on promotion are indicated by a "PROMO" sticker or a strikethrough price; promotions are valid while stocks last and during the display period.

For deliveries outside France, the CUSTOMER may be subject to local taxes and customs duties in force in the country of receipt; such duties and sums remain the CUSTOMER's responsibility.

Product prices do not include processing and shipping costs, which are charged in addition according to the order amount and shown before validation.

Article 4 - Order

The contractual information is presented in English and is subject to a confirmation restating this information no later than at the time of delivery. Germie SAS reserves the right to cancel or refuse any order from a CUSTOMER with whom a dispute exists relating to payment for a previous order.

To order Products on the Site, the CUSTOMER may create an account by providing the information requested in the registration form. They declare that they provide complete and accurate personal information allowing them to be identified; any incorrect information may result in closure of the account and cancellation of the order.

The account creation section is accessible directly from the main menu. On each visit, the CUSTOMER may log in to place an order or view their account (order status, personal information, etc.).

Article 5 - Payment

The price of the Products, together with the preparation and delivery costs, is payable in full by the CUSTOMER at the time of the order.

Payment is made using the payment methods offered when the order is confirmed. For card payments, the CUSTOMER is redirected to the payment provider secure interface to enter their bank details securely. If payment is accepted, the order is recorded and the contract is definitively formed.

No shipment will be made before full payment for the order has been received.

Article 6 - Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, the CUSTOMER has fourteen (14) days from receipt of the Products to exercise their right of withdrawal, without having to give a reason or pay any penalty.

To exercise this right, the CUSTOMER may use the online withdrawal form available at germie-en.mywizi.com/cancellation-form.html, or send any unambiguous statement to contact@germie.eu or by post to Germie SAS, 10 Chemin de Prat Meur, 22970 Coadout, France.

The Products must be returned in their original packaging, complete and unused, together with the delivery note. Return costs are borne by the CUSTOMER.

Germie SAS refunds the amounts paid (excluding return costs) within fourteen (14) days of receiving the returned Products or proof of their dispatch.

Article 7 - Delivery

Once payment for the order has been received, the Products are delivered to the delivery address indicated by the CUSTOMER when placing the order. An email is sent to the CUSTOMER to inform them that the Products have been dispatched.

Deliveries are made in mainland France and to the European destinations offered when ordering. Shipping costs are calculated according to the delivery method chosen, the weight of the parcel and the destination, and are displayed before the order is confirmed.

Delivery times are given for information only. If thirty (30) days from the order are exceeded, the sales contract may be terminated and the CUSTOMER refunded.

It is up to the CUSTOMER to check the condition of the parcel on receipt and, where applicable, to make the usual reservations with the carrier.

Article 8 - Warranties

All Products offered by Germie SAS on the Site benefit from the legal guarantee of conformity (articles L.217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). If a Product sold is non-compliant, it may be returned to Germie SAS, which will take it back, exchange it or refund it.

In addition to the legal guarantees, Germie SAS offers a commercial warranty of ten (10) years on Germie kits and sprouters and two (2) years on electronic products (Gardiscan, LED light, heating mat) as well as on the cultivation tray, from the date of purchase.

Any complaint or request for exchange or refund must be sent by email to contact@germie.eu or by post to Germie SAS, 10 Chemin de Prat Meur, 22970 Coadout, France, within thirty (30) days of delivery.

Article 9 - Liability

Germie SAS has, for all stages of access to the Site, the ordering process, delivery, customer service or the services subsequent, only a best-efforts obligation. Its liability cannot be incurred for any inconveniences or damage inherent in the use of the Internet network, in particular loss of data, intrusion, viruses, interruption of service and other involuntary problems, or any event qualified as force majeure in accordance with case law.

The computerised records kept in Germie SAS information systems under reasonable security conditions will be considered as evidence of the communications, orders and payments between Germie SAS and the CUSTOMER.

Article 10 - Security

The Site is subject to a security system: SSL encryption has been adopted and all scrambling and encryption processes have been strengthened to protect all sensitive data relating to payment methods as effectively as possible.

Article 11 - Intellectual property

All texts, comments, works, illustrations and images reproduced on the Site are reserved under copyright worldwide. Accordingly, and in accordance with the provisions of the French Intellectual Property Code, only private use is authorised. Any total or partial reproduction of the Site is strictly prohibited, whether in the form of a photo, logo, visual or text.

Article 12 - Personal data

The data provided on the Site is necessary for processing orders and is processed by Germie SAS in compliance with the French Data Protection Act and the General Data Protection Regulation (GDPR), as detailed in the Site Legal notice.

Article 13 - Force majeure

The performance by Germie SAS of all or part of its obligations, in particular delivery, will be suspended in the event of a fortuitous event or force majeure that hinders or delays performance: war, riot, insurrection, social unrest, strikes of any kind, natural disasters, etc.

Germie SAS will inform the CUSTOMER within seven (7) days of the event. If the suspension continues beyond fifteen (15) days, the CUSTOMER may cancel the order in progress; the price of the Products ordered and the delivery costs paid will then be refunded.

In the event of a dispute, the CUSTOMER may use a consumer mediator free of charge to resolve the disagreement amicably, in accordance with articles L.612-1 et seq. of the French Consumer Code. Failing an amicable solution, the dispute will be submitted to the competent courts under ordinary law.

These Terms and Conditions of Sale are governed by French law.
